Painting Best Practices is an educational website and membership service operated by Natural Pigments LLC. These Terms of Service govern your access to and use of the Painting Best Practices website, courses, memberships, live sessions, recordings, community features, downloadable materials, and related services.

By accessing or using Painting Best Practices, creating an account, purchasing a membership, registering for a session, posting in the community, or using any related service, you agree to these Terms. If you do not agree, do not use the website or services.

These Terms apply to all visitors, registered users, members, course participants, and purchasers.


1. About Painting Best Practices

Painting Best Practices provides educational information about artists’ materials, painting techniques, conservation research, studio practice, and related subjects. The site may include articles, videos, courses, live sessions, recorded sessions, downloadable resources, community discussions, product references, and other educational content.

Painting Best Practices is operated by Natural Pigments LLC. References in these Terms to “Painting Best Practices,” “PBP,” “we,” “us,” or “our” mean Natural Pigments LLC and the Painting Best Practices website and services it operates.


2. Educational Information Only

The information provided on Painting Best Practices is for educational purposes only.

Painting Best Practices does not provide professional conservation treatment advice, restoration advice, appraisal advice, legal advice, health or safety advice, engineering advice, or any guarantee that a particular material, method, technique, product, or procedure will produce a specific result.

Painting materials and techniques can behave differently depending on many variables, including but not limited to:

  • the materials used;
  • the support and ground;
  • pigment composition and particle characteristics;
  • binder type and amount;
  • layer thickness;
  • absorbency of underlying layers;
  • environmental conditions;
  • drying and curing conditions;
  • application method;
  • storage and display conditions;
  • the artist’s execution.

You are responsible for evaluating whether any information, technique, product, or method is appropriate for your own artwork, studio, safety practices, and circumstances. When appropriate, consult a qualified conservator, safety professional, legal advisor, or other specialist before relying on information for valuable, historic, commercial, hazardous, or technically sensitive work.

We may revise educational content as new information becomes available. Older articles, videos, comments, recordings, or discussions may not reflect the most current research, recommendations, or policies.


3. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account, purchase a membership, register for paid services, or enter into these Terms.

If you use Painting Best Practices on behalf of a business, organization, school, studio, or other entity, you represent that you have authority to bind that entity to these Terms.


4. Accounts and Login Credentials

You may be required to create an account to access memberships, courses, live sessions, recordings, community features, or other services.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree not to:

  • share your username or password with another person;
  • allow another person to access paid or member-only content through your account;
  • use another person’s account without permission;
  • create false, misleading, duplicate, or fraudulent accounts;
  • attempt to bypass access controls, membership restrictions, or payment requirements.

We may suspend or terminate an account if we believe the account has been shared, misused, compromised, used fraudulently, or used in violation of these Terms.


5. Memberships, Subscriptions, and Paid Access

Painting Best Practices may offer paid memberships, courses, live sessions, recordings, downloadable resources, and other paid services.

Membership benefits, pricing, billing intervals, access rights, and included services are described on the applicable membership, course, checkout, or registration pages. Those descriptions are incorporated into these Terms.

Membership access may vary by tier. Some content, live sessions, recordings, community areas, courses, or resources may be available only to certain membership levels.

We may change membership benefits, content, pricing, or service structure from time to time. Changes will not reduce access to content you have already purchased for a fixed term unless required for legal, technical, security, rights, platform, or operational reasons.


6. Automatic Renewal

Some memberships and subscriptions renew automatically unless canceled before the renewal date.

By purchasing an automatically renewing membership or subscription, you authorize us or our payment processor to charge your payment method on a recurring basis according to the billing interval, price, and terms shown at checkout.

Before completing a purchase, the checkout page will identify the membership or subscription, billing interval, price, trial terms if applicable, and renewal terms. You should review this information carefully before submitting payment.

After purchase, you will receive an acknowledgment or confirmation of your order or subscription. It is your responsibility to retain this information.

You may cancel an automatically renewing subscription as described in the cancellation section below.


7. Free Trials, Introductory Offers, and Promotional Pricing

Painting Best Practices may offer free trials, low-cost trials, introductory pricing, coupons, promotional access, or limited-time offers.

Trial and promotional terms are governed by the terms displayed at the time of checkout or registration. These terms may include:

  • trial length;
  • trial price;
  • post-trial subscription price;
  • billing interval after the trial;
  • eligibility limits;
  • one-trial-per-person restrictions;
  • expiration dates;
  • content-access limitations;
  • cancellation requirements.

Unless otherwise stated at checkout, a trial subscription will automatically convert to a paid subscription at the end of the trial period unless canceled before the trial ends.

We may limit trial or promotional offers to new members, first-time purchasers, one use per person, one use per household, one use per billing method, or one use per email address. We may deny, revoke, or cancel trial access if we believe the offer is being misused.


8. Cancellation

You may cancel an automatically renewing membership or subscription through your account area or by following the cancellation instructions provided on the website or in your subscription confirmation.

Cancellation stops future renewal charges. Unless otherwise stated, cancellation does not automatically refund past charges and does not necessarily provide a prorated refund for the current billing period.

After cancellation, your access may continue until the end of the paid billing period, unless your account is terminated for violation of these Terms, nonpayment, chargeback, fraud, abuse, or misuse.

Cancellation requests must be received before the renewal date to avoid the next charge. We are not responsible for renewal charges resulting from late cancellation requests, failed delivery of cancellation messages, use of the wrong contact method, or failure to complete the cancellation process.


9. Refunds

Unless a specific refund policy is stated on the applicable purchase page, all purchases are subject to the refund rules below.

Memberships

Membership fees are generally nonrefundable once charged. If you cancel a membership, cancellation stops future renewal charges but does not automatically refund charges already paid.

We may, at our discretion, issue a refund in cases of duplicate billing, technical error, accidental duplicate purchase, or other circumstances we determine appropriate.

Trials

Trial fees, including low-cost introductory trial fees, are generally nonrefundable unless required by law or unless we determine that a billing error occurred.

If a trial converts to a paid subscription, the first paid subscription charge is generally nonrefundable unless canceled before the trial ends or unless required by law.

Courses

Course purchases are generally nonrefundable once course content has been accessed, viewed, downloaded, or otherwise made available, unless otherwise stated on the course purchase page.

Live Sessions

Purchases for live sessions, webinars, Technical Studio Sessions, workshops, or similar events are generally nonrefundable unless the event is canceled and not rescheduled.

Failure to attend a live session does not automatically entitle you to a refund or replay access.

Replays and Recordings

Replay access is governed by the membership tier, purchase terms, or event terms stated at the time of purchase or registration. Buying access to a live session does not automatically include access to a recording unless this is expressly stated.

Chargebacks

If you initiate a chargeback or payment dispute, we may suspend access to your account while the dispute is pending. If a chargeback is resolved against us or appears fraudulent, we may terminate access to the related account or services.


10. Live Sessions, Webinars, and Recordings

Painting Best Practices may offer live sessions, webinars, studio clinics, Technical Studio Sessions, workshops, Q&A sessions, community discussions, or similar events.

We may use third-party platforms such as Zoom, Vimeo, or other services to host, record, stream, or distribute these events. Your use of those services may also be governed by their own terms and privacy policies.

We may record live sessions. Recordings may include participant names, voices, questions, chat messages, or other contributions if those features are used during the session.

By participating in a live session, you consent to the recording and use of your participation for educational, archival, member-access, replay, or promotional purposes, unless otherwise stated for a specific event.

You agree not to record, copy, download, redistribute, publish, sell, share, stream, or otherwise distribute live sessions, recordings, chat transcripts, slides, handouts, or other session materials without our express written permission.

We may reschedule, modify, or cancel live sessions for technical, staffing, platform, operational, safety, or other reasons. If a paid live session is canceled and not rescheduled, we will determine the appropriate remedy, which may include a refund, credit, replacement session, or other accommodation.

We are not responsible for technical problems caused by your internet connection, device, browser, email provider, third-party platform account, Zoom settings, spam filters, or failure to complete registration instructions.


11. Courses, Lessons, Resources, and Downloadable Materials

Courses, lessons, articles, videos, guides, handouts, slides, diagrams, downloads, and other educational materials are provided for your personal educational use only unless otherwise stated.

You may not:

  • copy, reproduce, repost, or republish course materials;
  • distribute member-only materials to nonmembers;
  • upload PBP materials to another website, social platform, file-sharing service, or AI training dataset;
  • sell or sublicense PBP content;
  • use PBP content to create competing courses, publications, paid resources, or commercial training materials;
  • remove copyright notices, watermarks, attribution, or access restrictions;
  • scrape, crawl, index, or bulk-download content.

Limited personal notes and brief quotations for private study are permitted. Any other use requires our prior written permission.


12. Community Areas and Member Conduct

Painting Best Practices may provide community features, discussion areas, comments, member forums, group discussions, private or semi-private posts, direct messaging, event chat, or other interactive areas.

You are responsible for anything you post, upload, submit, share, or communicate.

You agree not to post or transmit content that:

  • is unlawful, fraudulent, deceptive, defamatory, harassing, threatening, abusive, hateful, discriminatory, obscene, exploitative, or invasive of privacy;
  • infringes another person’s copyright, trademark, publicity rights, privacy rights, or other rights;
  • contains malware, tracking code, phishing links, spam, or harmful files;
  • impersonates another person or misrepresents your affiliation;
  • discloses another person’s private information without permission;
  • promotes unsafe studio practices, hazardous procedures, or technical claims in a misleading or reckless manner;
  • presents speculation, anecdote, or personal opinion as established fact in a way likely to mislead other members;
  • contains commercial solicitation, advertising, affiliate links, fundraising, or self-promotion without permission;
  • disrupts the community or interferes with other users’ ability to participate.

We may moderate, edit, hide, move, restrict, or remove content at our discretion. We may also suspend or terminate accounts that violate these Terms or interfere with the purpose of the community.

We are not obligated to review all user content and do not endorse user content. Community posts may contain errors, opinions, speculation, outdated information, or advice that is not suitable for your circumstances.


13. User Content

You retain ownership of content that you submit, post, upload, or share through Painting Best Practices, subject to the license granted below.

By submitting user content, you grant Natural Pigments LLC and Painting Best Practices a nonexclusive, worldwide, royalty-free license to host, store, copy, reproduce, display, perform, transmit, distribute, reformat, excerpt, moderate, and otherwise use the content as reasonably necessary to operate, provide, improve, protect, and promote the services.

This license includes the right to use questions, comments, examples, and non-confidential submissions for educational purposes, including responding to questions, developing lessons, improving resources, preparing technical discussions, and creating member educational materials.

We will not intentionally identify you publicly outside the membership area or reproduce images of your artwork in public promotional materials without your permission, except where your content was already submitted to a public area of the website or where use is required to operate the service, comply with law, enforce these Terms, or protect rights and safety.

You represent that you have the necessary rights to submit any content you provide and that your content does not violate the rights of any third party.

We may remove user content at any time, but we are not obligated to do so. We do not guarantee that user content will be stored, preserved, backed up, or recoverable.


14. Intellectual Property

All content and materials provided by Painting Best Practices or Natural Pigments LLC, including but not limited to text, articles, videos, course materials, lesson content, graphics, diagrams, photographs, slides, downloads, logos, trademarks, trade names, design elements, page layouts, software elements, and compilations, are owned by or licensed to Natural Pigments LLC unless otherwise stated.

These materials are protected by copyright, trademark, trade dress, and other intellectual-property laws.

Your access to the website or services does not transfer ownership of any intellectual property to you.

You may not use the names, trademarks, logos, trade names, or branding of Painting Best Practices, Natural Pigments, Rublev Colours, or related brands without prior written permission.

These may include payment processors, membership software, learning-management systems, email-service providers, analytics tools, video-hosting platforms, webinar platforms, community software, security tools, and embedded content providers.

Your use of third-party services may be subject to the terms, privacy policies, and practices of those third parties. We are not responsible for third-party websites, platforms, policies, failures, interruptions, errors, security incidents, or content.

By using the services, you authorize us to share information with third-party providers as reasonably necessary to operate the website, process payments, provide access, send communications, host events, deliver content, maintain security, and administer memberships.


17. Affiliate Links and Product References

Painting Best Practices may include product references, links to third-party websites, or affiliate links. If you purchase through an affiliate link, Natural Pigments LLC may receive a commission or other compensation.

Product references are provided for educational or informational purposes and do not necessarily constitute an endorsement, guarantee, warranty, or representation that a product is suitable for your specific use.

You are responsible for evaluating product suitability, safety information, manufacturer instructions, and applicable laws before purchasing or using any product.


18. Payments and Billing Information

Payments may be processed by third-party payment processors. We do not necessarily store complete payment-card information on our servers.

You agree to provide accurate, current, and complete billing information. You authorize us and our payment processors to charge all amounts due for purchases, memberships, renewals, taxes, fees, or other charges associated with your account.

If your payment method fails, expires, is declined, or is reversed, we may suspend or terminate access to paid services. You remain responsible for unpaid amounts.

Prices may be changed at any time. Price changes for existing subscriptions will be handled according to applicable law and the terms provided at the time of notice or renewal.


19. Taxes

Prices may not include applicable taxes unless stated otherwise. You are responsible for any sales tax, use tax, VAT, GST, duties, fees, or other governmental charges associated with your purchase, except for taxes based on our income.


20. Email and Communications

By creating an account, purchasing a membership, registering for an event, or using the services, you agree to receive transactional and administrative communications related to your account, purchases, membership, access, billing, security, policy updates, and services.

You may also choose to receive newsletters, educational emails, promotional messages, or other marketing communications. You may unsubscribe from marketing emails using the unsubscribe link provided in those emails. Transactional or administrative emails may still be sent when necessary.

You are responsible for providing a valid email address and for checking spam, junk, promotions, or filtering folders for access instructions, registration links, renewal notices, or other important communications.


21. Prohibited Uses

You agree not to use Painting Best Practices or its services to:

  • violate any law or regulation;
  • infringe intellectual-property rights or privacy rights;
  • harass, abuse, threaten, defame, or discriminate against others;
  • submit false, misleading, or fraudulent information;
  • interfere with website security or access controls;
  • attempt to gain unauthorized access to accounts, systems, or restricted content;
  • share, sell, rent, or transfer account access;
  • copy, scrape, crawl, harvest, or bulk-download website content;
  • upload malware, malicious code, or harmful files;

Termination for violation of these Terms does not entitle you to a refund unless required by law or expressly agreed by us.

You may stop using the services at any time. Cancellation of a paid subscription is governed by the cancellation section above.


23. Availability and Changes to Services

We may modify, update, suspend, discontinue, replace, or remove any part of the website or services at any time.

We do not guarantee uninterrupted access to the website, courses, recordings, community features, downloads, live sessions, or third-party platforms.

Access may be affected by maintenance, updates, technical failures, security issues, hosting failures, platform outages, payment issues, account problems, internet disruptions, or events beyond our control.

We are not liable for temporary unavailability, data loss, platform failure, or service interruption except where required by law.


24. Backups and Data Loss

We may maintain backups for operational purposes, but we do not guarantee that any account data, user content, posts, comments, messages, files, course progress, chat history, or other materials can be restored.

You are responsible for keeping your own copies of any content, notes, images, or information that you wish to preserve.


25. Privacy

Your use of Painting Best Practices is also governed by our Privacy Policy.

26. Disclaimers

Painting Best Practices and all related content, services, materials, courses, live sessions, recordings, downloads, community features, and website functions are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Natural Pigments LLC disclaims all warranties, express or implied, including but not limited to warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, and error-free service.

We do not warrant that:

  • the website or services will meet your expectations;
  • content will be complete, current, accurate, or suitable for your specific purpose;
  • access will be uninterrupted or secure;
  • errors will be corrected;
  • recordings or downloads will remain available indefinitely;
  • community content will be accurate or reliable;
  • techniques, methods, or materials discussed will produce any particular artistic, technical, conservation, commercial, or archival outcome.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the fullest extent permitted by law.


27. Limitation of Liability

To the fullest extent permitted by law, Natural Pigments LLC, Painting Best Practices, and their owners, officers, employees, contractors, contributors, affiliates, suppliers, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including but not limited to lost profits, lost revenue, lost data, loss of goodwill, business interruption, damage to artwork, loss of access, or cost of substitute services.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the website, services, content, membership, course, live session, recording, purchase, or these Terms will not exceed the greater of:

  1. the amount you paid to Painting Best Practices for the specific service giving rise to the claim during the twelve months before the claim arose; or
  2. one hundred dollars.

This limitation applies regardless of the legal theory, including contract, tort, negligence, strict liability, warranty, statute, or otherwise, even if we have been advised of the possibility of damages.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, the limitations apply only to the fullest extent permitted by law.


28. Indemnification

You agree to indemnify, defend, and hold harmless Natural Pigments LLC, Painting Best Practices, and their owners, officers, employees, contractors, contributors, affiliates, suppliers, licensors, and service providers from and against any claims, demands, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your use of the website or services;
  • your violation of these Terms;
  • your user content;
  • your infringement of another person’s rights;
  • your misuse of educational information;
  • your violation of law;
  • your sharing or redistribution of restricted content;
  • your conduct in community areas or live sessions.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.


29. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where the laws of your jurisdiction require otherwise.

You agree that any dispute arising out of or relating to these Terms, the website, or the services will be brought in the state or federal courts located in California, unless applicable law requires a different forum.

You waive any objection to jurisdiction or venue in those courts to the fullest extent permitted by law.


30. Informal Resolution

Before filing a legal claim, you agree to contact us and attempt to resolve the dispute informally.

We will attempt to respond within a reasonable time. This section does not prevent either party from seeking urgent relief where necessary to protect intellectual property, security, safety, or legal rights.


31. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may notify users by posting the updated Terms on the website, changing the “Last Updated” date, sending an email, displaying a notice, or using another reasonable method.

Your continued use of the website or services after updated Terms become effective means you accept the updated Terms.

If you do not agree to updated Terms, you must stop using the website and, if applicable, cancel your membership or subscription.


32. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable, or removed if modification is not possible.


33. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.


34. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, restructuring, change of control, or transfer of the website or services.


35. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented at checkout, registration, membership signup, course enrollment, or event registration, constitute the entire agreement between you and Natural Pigments LLC regarding Painting Best Practices.

If there is a conflict between these Terms and specific terms presented for a particular purchase, membership, course, or event, the more specific terms control for that purchase, membership, course, or event.
